ACTION ITEMS / EVENTS / UPDATES A few things that were not covered in the call, but we'd like to update you on: - Moira Hahn and Mark Hotchkiss in Long Beach, CA have sent out a press release regarding the latest news on their fight against a cell tower construction in their front yard. - The deadline to tell the FCC to recognize EMS as a legitimate health condition and those disabled by it has been extended to April 20th!
- Ruth Moss gave an update on what is going on with White Plains, NY and what
is going on with branding.
- White Plains, NY is going to be passing a protective telecom ordinance on April which will culminates almost three and a half years of work and a lot of personal contact. However, they are dealing with pushback from the mayor's legal counsel right now. They're questioning whether westchester county can rely on the Flower Hill decision - but it is a federal court!
- The Flower Hill decision is final!!! It is no longer under appeal.
- Ruth also spoke about our entire community coming together under one name
- Ruth also addressed how we talk about EMS and suggested we use the word - "injured" versus EMS...And to start thinking in those terms because she feels it's a much more powerful expression.
- Doug Wood talked about the American's for Responsible Technology Webinar on The Rights of Citizens in the Deployment of Wireless Infrastructure designed for local attorneys and local public officials (which took place yesterday afternoon).

- Michael Muadin in Lebanon, NY - Alliance for Microwave Radiation Accountabiliy (AMRA) let us
know that all of you who responded to Lebanon's call for help made a big difference!
- Lebanon, NY decided to delay the impending telecom code for as long as needed to do it right.
They also said they are willing to spend the necessary money and interview attorneys with proper telecommunications backgrounds and are reaching out to citizens regarding lawyers and citizens feel they want and need in a code.
- Michael sincerely thanked everyone who responded to the action alert for Lebanon because it added to
their ability to apply pressure and ultimately helped the officials come to this decision!
- Odette gave a few updates:
- New York City cell phone tower situation...
- The NYC jumbo cell phone towers initial pilot program includes 200 of these towers - but once
the pilot program is over they are shooting to install up to 7,500 cell phone towers.
- Odette and others, including EHT are still working hard to get to all 59 community boards (which advise the city) and so far 9-10 of the boards have voted for a moratorium and/or sent a letter of disapproval.
- They're shooting to get at least 20 of the 59 community boards total to
disaprove
- There was a meeting with the public advocates office on Monday, which Odette will update about on the next call National Call

- UK Update: Neil McDougal and Collette Harris
- Neil spent last week with karen churchill who is facing an appeal with the Mansfield case which is challenging ICNRP reliance on human rights grounds because it was turned down. It went to high court on judicial review and it was unsuccessful - and they decided there wasn't a case for appeal. See below for the outline of the case and plan for challenges.
- UK legal challenges to
5G rollout since 2019 on 'reliance on ICNIRP guidance' (1), human rights implications of 'reliance on ICNIRP' (2), consultation on planning deregulation (3), and planning objector rights/EECC obligations of local/municipal planning authorities (4), and the 'Save Belgium' on-going legal challenge (in Belgium) to the legality of the European Council 1999/519/EC Recommendations (5), are important elements of campaigning as described by Bill Moyer here:
Stage two: prove the failure of institutions 'the opposition must prove both that the problem exists and that the official powerholders and institutions perpetuate the problem. Therefore, the opposition must:- Undertake research to prove that a problem exists which violates social values and sensibilities.
- Prove that the official doctrine and
policies of governmental powerholders and institutions violate society's values and the public trust. This must be not only from researching the facts but also from actually trying every avenue for official citizen participation in the democratic process for deciding on social policies and programs, and proving that they do not work.
• Testify, undertake challenges, and file complaints in every branch of the bureaucratic machinery at the local, state, and
federal level of both public and private bodies that are supposed to be open for citizen participation and redress. • Prove that they are "kangaroo courts". Go to every decision-making body whether welcome or not. • File suit in the courts. • Take their concerns to city council, state assembly, and national Congress. These programs are usually primarily carried out through the
auspices of professional opposition organizations.
- Positive results are not expected now. The point is not to win the cases, but to prove that the powerholders are preventing the democratic system from working. Eventually, however, some of these cases might actually be won and have the powerful impact of creating a movement and social change'

- The circumstances that led to a legal challenge can be 'reversed engineered' to gain insight into:
- how
the case might have been avoided through a more effective alternative dispute resolution procedure,
- how a legal barrier to the case succeeding could have been overcome by arguing the case differently, or by the failed challenge revealing new perspectives on the interrelationship between the multiple issues at stake which are significant and remain unresolved,
and, - how
a failure of a public authority might have been challenged more effectively, without initiating a legal challenge or through initiating a different type of legal challenge'.
