- Answered A LOT of questions and sparked a great discussion regarding EMS and ADA. Below are some of the questions and answers - please view recording of call for full responses as this was taken down quickly during the call. Disclaimer (from Jay) - He is not a lawyer and can't give legal advice.
- Donna Ott - Someone at the MidAtlantic
ADA Center told me that the ADA does NOT cover EMS/accommodations by utility and telecom companies. Is this really true?
- Answer: The way you worded this - this is correct. The utility company may not be subject to the ADA. It’s the local municipalities that allow it that have to be approached for discrimination for allowing this, which means they are issuing these permits for towers/cell phones
discriminatorily.
- Suggested ways to respond in medical situations or situations you are presented with wireless electronics and you can't use them:
- "I can't sign that, I Have to have a hard copy because of my disability"
- Wear an audio recorder around neck when you
are going into a possibly intense situation
- ADA has no official list of disabilities. The ADA defines disabled as Physical or mental impairment that severely limits life activities. EMS is a disability that substantially limits one or more life activities. The ADA is very broad in its application.
- Medicaid is not subject to ADA - it would
be REHAB Act
- Are utilities subject to Title 3?
- Eva: According to attorney Scott McCullough: The private companies are Title III entities under the ADA -- private companies are required to comply with the law (see attached transcript of interview with Scott M.)
- Mary:
What if the telecom or public utility is on a public right away.
- Not sure. There is an implied easement to your house for utilities so that may be something you can revoke? Something to look into. Give them notice of it.
- Does the internet fall under ADA accommodations?
- The internet is a place of public accommodations...in some cases you have to pay your bills online or are required to have an online account to access services. There is a sufficient nexus - an interaction that creates a predictable public interaction with you.
- Search internet as public accommodation - go to understandingtheada.com - then type in "If a sufficient nexus exists" - give you
insight as how it may be applicable to wireless because they're using wireless to promote the internet
- Health Department is a really good point of pressure for ADA
- Sidnee asked question about what can be done about macro tower in Sebastapol, CA on city property that is right over the public library
- Answer: City is benefiting by discriminating against people with EMS. Do research first - who owns property - get records/deeds/tax GIS records, do a public records request about agreement
- Ask "what research have you done to ensure this won't affect those with EMS, that this agreement was ADA compliant and does not discriminate or deprive people with disabilities from equally accessing the
programs, activities, or services?"

- Include in your submission to the FDA docket:
- How would your life be different if the FDA had warned that wireless was potentially dangerous? Tell your story, or that of a friend/family member. Also, in the petition look for some suggested solutions we can provide to the FDA as to how they can comply with the law, educate on bio-harm and help keep citizens safer.
Warnings are on cigarette labels, 60 years ago the Surgeon General was writing, even to children, about the dangers of smoking. The same needs to be done re EMF’s. This is not limited to radio frequencies.
- Federal Bills Update and Action:
UPDATES/ NEWS - We are asking for more volunteers for minute-taking during the National Call meetings. So far, two people have volunteered and we are looking for at least two more. This would be on a rotating basis (we are shooting for once every 3 to 4 calls). Please respond back if you are willing to do this!
- Neil McDougall from the UK updated us on
what he is working on:
- Neil explored European law and the way the British government changed the constitution upon their withdraw, and he found a clause that allows the public to challenge to government.
- He and Karen Churchill are challenging on jurisdictional grounds and are concentrating on a legal document -
presenting the government with 21 remedies that it must enforce to be compliant to its obligation under European law. It exposes failure of UK government, so the would have to backtrack to 2018 and properly apply UK law.

- The website is still under construction and will be starting with five
main pages and branch out from there. Looking to get the federal bill fact sheets and filings up.
- We are calling for pictures of YOU using a wired connection and/or wires (wired headphones, wired "smart" device, wired ethernet connection to computer, children using wired connections, etc.). - Josh Hart with StopSmartMeters.org update:
- They lobbied Plumas County, CA to provide ethernet connections in the library based on ADA
claims and the county will be providing wired connections in the library now. If you'd like to know how they did this, contact Josh! (Contact info is on his website above)
- Josh is working to develop a 15 acre refuge
- Amazon is one of the predominant proliferators of wireless so we should avoid buying from
them
- Odette moderated Virtual Town Hall #4 today from 4-6pm EST on Broadband Freedom of Choice, featuring Gigi Sohn, former Biden appointee to the FCC, Kim McKinley, Chief Mktg Officer of Utopia Fiber, and Tim
Schoechle, fiber expert. She will update us on our next National Call September 15th.

- Medicare and Medicaid were just hacked; now sending letters to millions informing them that their medical and personal information may have been stolen on May 31, 2023. Cybersecurity should be top of mind for our government. Wireless, especially 5G, should be
scrutinized, not excluded from the “NTIA Reauthorization Act” moving through Congress now in HR 4510. Please let your legislators know how important this is. Safer, more secure, wired connections for the internet should be mandated to and through all buildings that are using federal monies.
